Terms & Conditions

Effective date: 1 February 2026

By booking Jayda Smith Photography (“the Photographer”), you (“the Client”) agree to the following Terms & Conditions. These are designed to protect both parties and ensure a smooth and professional experience.

Booking & Confirmation

  1. Bookings can be made via Instagram DM, WhatsApp, or email.
  2. A booking is only confirmed once the deposit of 50% has been paid.
  3. To secure your date, the deposit should be paid as soon as possible. For bookings close to the event date, the deposit must be paid at least 24 hours before the event.
  4. Payment methods accepted: EFT.

Payment & Late Fees

  1. For portraits, couples, maternity, events, branding, and product photography:
    • The remaining balance is due after receiving the top 10 sneak peek images (sent within 3 days of the shoot).
  2. For corporate and product photography:
    • The remaining balance is due before receiving the full gallery.
  3. Late payment fee: 10% of the outstanding balance.
  4. Photos will only be delivered after full payment has been received.

Cancellation & Rescheduling

  1. Client cancellations:
    • If notice is given 48 hours before the shoot, the deposit is refundable.
    • If notice is given after 48 hours, the deposit is non-refundable.
  2. Rescheduling:
    • Clients may reschedule up to 3 times, provided notice is given at least one week in advance.
  3. Last-minute cancellations or no-shows:
    • Deposits will not be refunded.
    • If a client is late, they may continue for the booked time or pay double the hourly rate for the extended time.
  4. If the Photographer cancels due to illness, emergencies, or other unavoidable circumstances, the client may either reschedule or receive a full refund

Deliverables & Turnaround

  1. Clients receive:
    • Top 10 images: within 3 days after the shoot
    • Full gallery:
      • Weddings: within 4 weeks
      • Other services: within 2 weeks
  1. Delivery method:
    • Personalised online gallery with download code/password
    • USB delivery is available at an extra cost if requested
  2. Corporate/product photography: link to download full gallery online
  3. No guaranteed minimum number of images is promised, but all sessions will include professional coverage based on the package or hourly rate booked.

Editing & Retouching

  1. The editing style is artistic and consistent; clients acknowledge this as part of the service.
  2. Minor imperfections in images are normal.
  3. Clients may request 1 round of changes. Additional changes are charged at R10 per photo.
  4. RAW files are not provided.

Copyright & Usage Rights

  1. Copyright remains with Jayda Smith Photography.
  2. Clients may:
    • Print images
    • Share on social media
    • Use for personal purposes
  3. Commercial usage requires a separate agreement.
  4. Clients must provide credit/tagging when posting:
    • Instagram: tag @jaydasmith_photography
    • Other platforms: include business name, Instagram link, or website if possible
  5. The Photographer may use images for:
    • Portfolio
    • Website
    • Social media
    • Marketing purposes
  6. Clients who prefer their images not to be shared publicly may opt out in writing.

Client Responsibilities

  1. Clients are responsible for:
    • Arriving on time
    • Obtaining permits or permissions for venues
    • Cooperation of guests or subjects
  2. The photographer is not responsible for:
    • Missed shots due to lateness or uncooperative subjects
    • Venue restrictions
    • Weather or other uncontrollable conditions

Liability & Equipment Failure

  1. The Photographer is not liable for issues caused by:
    • Load shedding
    • Weather
    • Acts of God
    • Government restrictions
  2. In case of equipment failure, the Photographer’s liability is:
    • Limited to a refund or a reshoot where possible
    • No further claims may be made
    • Maximum liability is limited to the amount paid by the client

Dispute Resolution & Governing Law

  1. These Terms & Conditions are governed by South African law.
  2. If disputes arise, the following steps will be followed:
    • Direct discussion between the client and photographer
    • Mediation with a neutral third party if discussion fails
    • Legal action as a last resort

Travel & Additional Costs

  1. Travel within a 10km radius of the Photographer’s base location in Cape Town is included in the booking fee. Travel beyond this 10km radius will incur an additional travel fee, which will be communicated to the client in advance and added to the final invoice.
  2. Any additional costs (including but not limited to parking fees, toll fees, or accommodation for out-of-town shoots) will be discussed and agreed upon prior to the booking being confirmed.
  3. USB delivery of galleries incurs an additional cost if requested.

Non-Negotiables

  1. Deposit is non-refundable if cancellation occurs after 48 hours
  2. Booking is not confirmed without a deposit
  3. Photos are not delivered until the full balance is paid
  4. Editing style is artistic and consistent; no complete re-edits requested after approval
  5. The client must acknowledge that minor imperfections are normal
  6. Liability is limited as described above
